A man who was arrested Monday for not showing up to testify in a murder trial took the stand Wednesday.
Jerry Marbury testified during the trial of Tremaine Jackson, who is charged with murder in the December shooting death of Brian Rogers.
Prosecutors allege that Jackson shot Rogers, who lived near Ripley, near Littlepage Terrace on Charleston's West Side over a heroin theft.
Jackson's trial began Monday in Kanawha County Circuit Court.
Jerry Marbury was located Monday afternoon by police on Summers Street, after he failed to show up to court.
The court had issued what's called a "writ of body attachment," for Marbury, after he didn't show up to testify Monday. The writ operates as a warrant and allows police to arrest a person on site. After an arrest he or she is held in jail.
Marbury testified on Wednesday, along with Adam Kuhner. Both men had gone with Rogers to Littlepage the day he was killed, according to prosecutors.
Kanawha Circuit Judge Charles King let another witness in the case, Jazmin Mitchell, out of jail in June after she promised to come to court to testify in the case. She and Jackson have a child together.
Trial will continue at 9:30 a.m. today.
