Man shot and killed in trespassing incident at Fayette mine

One man is dead and a security guard injured after a trespassing incident at a mine in Fayette County.

West Virginia State Police were dispatched to a Frasure Creek Mining site near Oak Hill after a shooting complaint around 10 a.m. Wednesday, according to a news release from Capt. B.L. Mankins.

Troopers found Johnny Johnston Jr., 31, of Kincaid, dead from an apparent gunshot wound at the base of a high wall, the release said.

Gary Gover, 55, of Hilltop, was found with internal injuries consistent with a fall, according to the news release. Gover is a security guard at the mine and had confronted Johnston and another man, Russell Walker, 31, for trespassing on the property, the release said.

The confrontation turned violent and Gover discharged his firearm at the men, the release said. Walker left the site but was later located by troopers, according to the release.

The investigation is ongoing. Fayette County Sheriff's Department are assisting troopers with the investigation.
