The baby police said was shaken by his father a few weeks ago in Cross Lanes is expected to live.

Sgt. Brian Humphreys, spokesman for the Kanawha County Sheriff's Office, said the baby is expected to survive, but it's not yet known whether he suffered any long-term injuries.

Joshua Steven Albany, 24, was charged with child abuse causing injury, a felony, after he allegedly shook his 4-month-old son, causing bleeding on the brain, on Dec. 20. Police said Albany said he was frustrated by the child crying, keeping him awake.

Albany admitted to shaking the baby when reporters asked after his arraignment the next day.

The baby also suffered from a broken left collarbone and slight bruising on the left rib area.

Albany faces up to 10 years in prison.
