BERKELEY SPRINGS, W.Va. (AP) - A judge has dropped a heroin possession charge against a Berkeley County sheriff's candidate after prosecutors say evidence was obtained without a warrant.
The Journal reports a Morgan County judge dismissed the charge Tuesday against Republican John Orem.
Last week, Berkeley County prosecutors filed a motion to dismiss the charge, stating a State Police trooper didn't obtain a search warrant when he opened Orem's bathroom cabinet Aug. 2.
An earlier criminal complaint said Orem was found unresponsive at his Inwood home and that the trooper later took evidence from the cabinet.
Orem has said he has never used illegal drugs.
He says he's looking forward to focusing his attention back on his campaign and family. He will face Democrat Curtis Keller and independent candidate Lisa St. Clair in November.
